General Terms and Conditions
A. Rental Period and Usage

The minimum rental period for a vehicle is five (5) days.

The rental is granted for the period specified in the rental agreement.

The rental price includes sales tax (VAT), third-party liability insurance (WA), and unlimited mileage.

Fuel costs are not included. The vehicle will be delivered with a full tank and must be returned in the same condition. If the fuel tank is not refilled upon return, refueling costs plus a refueling service fee of USD 25 will be charged to the renter.

Vehicle delivery will be arranged in consultation with the renter. Deliveries to specific locations such as the airport may incur additional charges (see price overview).

The rental vehicle is intended solely for use as a passenger vehicle by drivers holding a valid driver’s license, as specified in the rental contract.
B. Responsibilities and Liability

The renter accepts the condition of the vehicle as it is at the time of signing the rental agreement.

The renter is required to treat and operate the vehicle with due care and diligence.

The renter is liable for all damages resulting from theft and any other damage to the vehicle, regardless of whether such damage is caused by the renter or third parties. A deductible of USD 500 applies per damage incident. Damage not covered by the insurer will be fully charged to the renter.

The renter indemnifies the rental company against all claims for damages to the renter, third parties, and/or property arising during the rental period for which the rental company may be legally liable but is not covered by the insurance policy.

In case of damage or an accident, the renter must notify the rental company immediately. In the event of an accident, the renter must also immediately inform Forensys (tel. 9233) and fully cooperate with their procedures. The renter may not move the vehicle until Forensys has granted permission. If the renter moves the vehicle without such permission, insurance coverage is forfeited, and all resulting costs will be borne by the renter.

The vehicle is insured with standard third-party liability insurance plus passenger accident insurance (coverage up to USD ………..). The insurance can be upgraded to comprehensive (all-risk) coverage for an additional fee.

The renter indemnifies the rental company for any fines, penalties, and administrative sanctions imposed on the rental company arising from offenses or violations committed by the renter, driver, or third parties during the rental period.
C. Payment and Security Deposit

The parties agree upon a net base rental price as stated in the rental agreement.

The full rental amount and security deposit are due on the day the vehicle is received.

If no damage is identified upon vehicle return, the deposit will be refunded on the same day or the following day.

In case of damage, the renter’s liability depends on the type of insurance selected. If the renter has explicitly opted for all-risk insurance as indicated in writing on the rental agreement, the deductible is USD 500. If no all-risk insurance was selected, the renter is fully liable for damages up to the current market value of the vehicle.
D. Use and Condition of the Vehicle

The renter is responsible for maintaining the vehicle in good condition for the duration of the rental period.

Smoking, transporting animals, and sitting in the vehicle with wet clothing are strictly prohibited.

The vehicle must be returned clean (broom clean). If not, a cleaning fee of USD 25 will be charged.

The renter must not continue to drive the vehicle if a warning light is illuminated.

The renter must not continue to drive the vehicle if the temperature gauge rises above the halfway point.

The renter is liable for any new dents, scratches, or other damage to the vehicle.

If salt stains are found on the upholstery upon return, a cleaning fee of USD 50 per seat will be charged.

The renter may not transfer the rental agreement nor sublet or otherwise lend the vehicle, in whole or in part, to third parties.

F. Final Provisions

If any provision of the rental agreement is wholly or partially void or unenforceable, the remaining provisions shall remain in full force and effect.

These general terms and conditions apply to all rental agreements issued by Island Wheels Curaçao.
-
Deviations from these terms are only valid if agreed upon in writing.
